Illegal? There's nothing illegal about someone releasing a server's repack (Besides Blizzard's part in this). People saying they have contracts are full of shit. You can't have contracts for an illegal private server. End of story, not getting into this bullshit because people don't read worth shit. The person who released this either had the source or did it from scratch because the server wasn't unique or good as I see from this repack.

No, people can share as long as they give credits and he gave credits. Who cares about the owner, the server is dead. Nobody hacked anything, it isn't THAT HARD to replicated a server like this. Actually, I can make this server and have all of its features in less than 2 hours. Stop trying to defend a dead server, it won't work. You can't have a contract, you can't copyright Blizzard's content and you certainly cannot take action from something so stupid.
